Can the department recover excess pay from a retired employee? The Rafiq Masih rule

Adv. Yash Nagar · High Court of Madhya Pradesh, Indore · November 2026

A common grievance of retired government employees in Madhya Pradesh is an order, often passed at the time of fixing pension, that excess pay was paid years ago because of a wrong pay fixation and will now be recovered from gratuity or pension. The law on this point is settled by the Supreme Court.

The rule in Rafiq Masih

In State of Punjab v. Rafiq Masih (White Washer), (2015) 4 SCC 334, the Supreme Court held in paragraph 18 that recovery by the employer is impermissible in law in the following situations:

  1. recovery from employees belonging to Class III and Class IV service (Group C and Group D);
  2. recovery from retired employees, or employees who are due to retire within one year of the order of recovery;
  3. recovery where the excess payment was made for a period of more than five years before the order of recovery was issued;
  4. recovery where an employee was wrongly required to discharge the duties of a higher post and was paid accordingly, even though he should have worked against an inferior post;
  5. any other case where the court concludes that recovery would be iniquitous, harsh or arbitrary to such an extent as would far outweigh the employer's right to recover.

The common thread is that the employee did not obtain the excess payment by fraud or misrepresentation; the mistake was the department's. The Supreme Court reiterated this approach in Thomas Daniel v. State of Kerala (2022).

The undertaking exception

Departments often rely on High Court of Punjab and Haryana v. Jagdev Singh, (2016) 14 SCC 267. There, the employee had given a written undertaking at the time of pay revision that any excess payment would be refunded, and recovery was permitted. Whether an undertaking was actually given, and in what terms, therefore needs to be checked in the service book before a challenge is filed.

What a retired employee should check

  • the date and reason given in the recovery order, and whether a show cause notice was issued before it;
  • the period over which the alleged excess was paid;
  • whether any undertaking was signed at the time of fixation;
  • the post held (Class III or IV) and the date of retirement.

Where the case falls within Rafiq Masih, the High Court ordinarily quashes the recovery and directs refund of any amount already deducted.
